Netherlands Commercial Court Update
The Netherlands Commercial Court (NCC) is a specialised court designed to meet the growing need for efficient dispute resolution of civil or commercial matters with an international aspect. The NCC will become a special chamber of the Amsterdam District Court. Judges and Staff of the NCC are selected from all the courts in the Netherlands for their specialised expertise.
The NCC operates under Dutch procedural law, which is highly regarded for its pragmatism and efficiency, while the working language of the NCC is English. It will also be possible for foreign lawyers to represent their clients before the NCC, although it is also required a Dutch lawyer is part of the formal litigation team. The jurisdiction of the NCC depends on forum consensus between the parties involved. The NCC will be equipped with state-of-the-art court technology.
The legislative proposal establishing the NCC will be reviewed by the House of Representatives in March 2018. Hopefully the NCC will open its doors soon and it is expected it will become an important player in the field of international dispute resolution.
